Video Transcribed: What is an automatic temporary injunction? Hi, my name is Brian Glass, and I am an attorney in Grady county. An automatic temporary injunction is an injunction that attaches automatically, as the name implies.
Whenever a petition for dissolution of marriage is served on a party, the automatic temporary injunction restrains people from doing things such as knowingly or intentionally destroying data that could be used during litigation of the divorce.
This information could contain information regarding your finances, relationship status, infidelity, or abuse allegations that may come up within this data. And it would also pertain to any electronic devices on which this information could be stored or any social media sites on which it could potentially be stored.
The automatic temporary injunction also will restrain people from making withdrawals from any retirement plans, pension plans, 401ks, profit sharing, or anything where any marital asset may be tied up. It will also restrain people from withdrawing or borrowing against any life insurance policy on the parties involved or their children.
While we’re on insurance, it’ll also restrain both parties from changing any beneficiary or payout for any life insurance, auto insurance, or health insurance.
It will also restrain them from canceling life insurance or auto insurance policies. Cannot cancel, change or divert any of the funds going into any of these policies during the pendency of the proceedings.
It will also restrain you from signing your spouse’s name to any negotiable instrument. Again, you can’t take a credit card out on their name without insurance payouts or checks. Any of these things will be restrained by this automatic temporary injunction.
And also, those couples having children will restrain you from secreting or keeping the children away from the other party or taking them out of state for any extended period. You can take them out of state for an agreed-upon vacation. But anything further than that, the courts will frown upon and could punish you for it.
